What is Call Recording?
Call recording is the process of capturing audio from telephone conversations for later playback, review, or analysis. Businesses use call recording for a wide range of purposes including quality assurance, compliance documentation, dispute resolution, employee training, and customer service improvement. For some regulated industries β such as finance and healthcare β recording certain calls is a legal requirement.
Understanding Call Recording Laws
Call recording laws govern what can and cannot be recorded and which parties must provide consent. In the United States, federal law requires one-party consent, meaning at least one person on the call must consent to the recording. However, several states have stricter two-party (or all-party) consent laws, meaning every person on the call must be informed and agree to the recording.
States requiring all-party consent include California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania, and Washington. When recording calls that cross state lines, the stricter law generally applies.
Internationally, regulations vary significantly. The European Union's GDPR imposes strict requirements around consent and the right to explanation for why a call is being recorded. Businesses recording international calls should ensure compliance with the laws of both the originating and terminating jurisdictions.
Best Practice: Regardless of jurisdiction, the safest approach is to always inform all parties that a call is being recorded β typically through an automated announcement at the beginning of the call. DIDLive recommends consulting with your legal team to ensure your recording practices comply with all applicable laws.
